Earlier this fall, CIU advised Branch Presidents that members should wait to complete the new CBSA conflict of interest attestation until the union had a chance to meet with the employer and obtain more information about this new CBSA requirement and its possible ramifications.
Since then, CBSA has consulted with the CIU National Executive to address major concerns regarding the COI yearly affirmation. In light of this consultation, we are satisfied that the employer has taken steps to answer questions around the implementation of this new policy. A FAQ prepared by the Agency, clarifying a number of issues related to the affirmation, has recently been sent to CBSA employees.
We can confirm that this new policy falls within the employer’s managerial rights. We therefore advise members who find themselves in a situation where a real or perceived conflict of interest could exist to complete the conflict of interest affirmation process diligently. As this is mandated by CBSA, please remember to fulfill this requirement during work time.
Please review the attached FAQ for more information on the conflict of interest affirmation process and its application.
In situations where members consider that their manager is acting beyond the established scope of the COI affirmation process, they should consult their Branch President. Should Branch Presidents require assistance on this matter, please contact the National Executive member assigned to your Branch.
